JENNA DUXBURY PHOTO, offers professional imagery services and licensing tailored for individuals, small businesses and short-stay accommodation. All copyright remains that of JENNA DUXBURY PHOTO and under no legal circumstance is ANY image or set of images to be used or forwarded/sold to a third party by the CLIENT or otherwise.

Unless agreed upon, JENNA DUXBURY PHOTO remains the copyright holder and all ownership or permission for their imagery to be used is to be granted prior of any use. In all circumstances, a signed IMAGE RIGHTS AGREEMENT is to be obtained by the CLIENT or THIRD PARTY for images taken by JENNA DUXBURY PHOTO to avoid the misuse of any images.

An IMAGE RIGHTS AGREEMENT is to be signed by all parties BEFORE rights are granted and image use is permitted.

If you are interested in using my images to promote your business or property, JENNA DUXBURY PHOTO offers licensing options that give you the flexibility you need to showcase your brand — whether online, in print, or across social media. Please note that under no circumstance are the images taken by JENNA DUXBURY PHOTO to be used across social media or marketing without written permission as each individual image is personalised.

Standard License Options Include:

Use on your website, social media, and marketing materials : My standard license allows you to use my images across all key marketing channels — including your website, social media platforms (eg. Instagram and Facebook), email newsletters, and general promotional materials. This gives you the freedom to consistently showcase your property with high-quality visuals that align with your brand.
Worldwide, non-exclusive rights: You’ll have the flexibility to use your licensed images anywhere in the world, with no geographical restrictions. The license is non-exclusive, meaning I may also license the same image to other clients unless otherwise agreed. If you require exclusive use of an image (so only your brand can use it), I offer that as a premium option.
Perpetual use (no expiry): There’s no time limit on your standard license — once you’ve licensed an image, you can continue using it indefinitely. This means you can confidently integrate the image into long-term marketing campaigns or keep it on your website for as long as you like, without worrying about renewal dates or additional fees.

If you require exclusive rights or full ownership of an image (meaning you will have complete control over its future use), custom pricing applies. This ensures your brand stands out with imagery that is uniquely yours.

Have we already worked together and you’re wishing to take the images further?

If we've already worked together, thank you! Your image package includes basic usage rights for specific AGREED purposes only (such as individual social media use). This does not include the rights to use these images elsewhere ie. in advertising, print etc. If you would like to EXTEND usage — for example, into marketing, print advertising, broader campaigns, or to obtain full rights ownership — additional licensing options are available.

Third Party Image Rights + Licensing:

All copyright remains that of JENNA DUXBURY PHOTO and under no legal circumstance is any image or set of images to be on forwarded/sold to a third party by the CLIENT.

In all circumstances, permission is to be granted to THIRD PARTY for images taken by JENNA DUXBURY PHOTO to avoid the misuse and an IMAGE RIGHTS AGREEMENT is to be obtained.

JENNA DUXBURY PHOTO remains the copyright holder and all ownership or permission for their imagery to be used by someone else eg. a stockist, third party client or photo agency. This requires a legal contract in an IMAGE RIGHTS AGREEMENT with outlined details on HOW the imagery can be used, how LONG the image rights is granted, and how much the compensation to the PHOTOGRAPHER.

An IMAGE RIGHTS AGREEMENT is to be signed by all parties before rights are granted and image use is permitted.

Here's a breakdown of what our image rights agreement involves:

Ownership vs. Licensing: JENNA DUXBURY PHOTO may choose to sell the complete ownership of the images or grant a license for specific uses while retaining the copyright. Selling OWNERSHIP means the buyer can use the images in any way they see fit without further permission from JENNA DUXBURY PHOTO. Alternatively, LICENSING involves granting permission for specific uses while retaining control over how the images are used.
Terms and Conditions: The IMAGE RIGHTS AGREEMENT will specify HOW the images can be used, WHERE they can be used, and for HOW LONG. For example, the CLIENT might be allowed to use the images for marketing purposes for one year, after which they would need to renew the license.
Exclusive vs. Non-exclusive: JENNA DUXBURY PHOTO may grant EXCLUSIVE rights to the buyer, meaning they are the only one who can use the images for a certain period within a specified context. NON-EXCLUSIVE rights allow the photographer to sell the same images to multiple clients.
Compensation: JENNA DUXBURY PHOTO will negotiate a fee for the use of the images. This fee can vary widely depending on factors such as the intended use of the images, the size and reach of the audience, and the exclusivity of the agreement.
Usage Rights: The IMAGE RIGHTS AGREEMENT will outline the specific ways in which the images can be used. This might include print or digital advertisements, website use, social media, editorial use, etc. JENNA DUXBURY PHOTO may restrict certain uses depending on their preferences and the nature of the agreement.
Credit and Attribution: The IMAGE RIGHTS AGREEMENT specifies that JENNA DUXBURY PHOTO must be credited whenever the images are used. This is specific to social media and website use.
Duration: The agreement will specify the duration of the license or ownership transfer. After this period expires, the CLIENT will need to renegotiate the terms if they wish to continue using the images.

JENNA DUXBURY PHOTO determines the price for image rights depending on several factors:

Usage: The intended use of the image is crucial. For example: Is it being used for a small local advertisement, a national campaign, or exclusive use.
Exclusivity: If the client wants exclusive rights to the image, meaning they're the only ones who can use it, the price will be higher compared to non-exclusive rights.
Image Complexity: Some product images might require more time and effort to create due to factors like the complexity of the product, the need for special equipment or props, model use or intricate lighting setups. This will influence the price of each specific image.
Duration of Use: All standard image licensing agreements will be caped at one year usage rights. If the client is wishing for longer periods this will be taken into account within the initial agreement.

Please note that there isn't a fixed rate for image rights, as it depends on all above factors and more. It's essential that JENNA DUXBURY PHOTO is granted time to carefully evaluate each clients specifics and negotiate terms that ensure fair compensation for their time, skill, and the value of their work.
